Terms of Service

1. Who we are and how to reach us

Studio Prompts (the “Service”) is operated by [OPERATOR: legal entity name — launch blocker], [OPERATOR: registered address — legal review required] (“we”, “us”). You can reach us at support@studioprompts.com for support and legal@studioprompts.com for legal notices.

These Terms of Service (“Terms”) apply to everything we make available at www.studioprompts.com, including the prompt library, animated backgrounds and gradients, templates, the Academy, the MCP server, custom prompt requests, the affiliate program and the creator program.

2. Accepting these Terms

By using the Service you agree to these Terms. If you do not agree, do not use the Service. If you use the Service on behalf of a company, you confirm that you have authority to bind that company, and “you” includes it.

You must be at least 18 years old, or the age of majority where you live, and legally able to enter into a contract. The Service is not directed at children.

3. Your account

Some features work without an account (browsing, copying free prompts within the daily allowance). Premium content, saved items, purchases, MCP access and programs require an account.

• Keep your credentials confidential. You are responsible for activity under your account.
• One person per account. Accounts are personal and may not be shared, pooled or resold. Team access is available on request.
• Give us accurate information and keep it current, in particular the email address we use to reach you about purchases and security.
• Tell us at support@studioprompts.com as soon as you suspect unauthorised access.

4. What the Service is

The Service is a curated library of design prompts, motion assets and learning material that you use with third-party AI builders and code tools of your choice. We do not operate those tools and do not control the output they generate from our prompts.

Prompts

Text instructions (website, app and section prompts, DESIGN.md files) that describe a design and its motion so an AI builder can reproduce it.

Assets

Animated backgrounds, gradients and related media files.

Templates

Starter projects that can be opened in supported builders or downloaded.

Academy

Free video and written lessons, including free example prompts.

MCP

A remote Model Context Protocol server that lets your AI agent search the library and fetch prompts you are entitled to.

Custom requests

Paid, private prompt work delivered to you individually.

We continuously add, update and occasionally retire items. The library at any moment is what is available; we do not promise that a specific item stays available forever, although anything you have unlocked remains accessible in your account for as long as the Service operates.

5. Purchases, plans and packs

Prices are shown in Studio Prompts’s display currency at the time of purchase and charged by our payment processor. Taxes may be added at checkout depending on your location. The amount confirmed by the payment processor is the amount you owe.

Plans, renewals, cancellations, lifetime access, prompt packs, fair-use limits and early access are described in the Membership Agreement. Refunds are described in the Refund Policy. Both form part of these Terms.

Guest checkout may be offered. An order placed without an account is linked to the account that later signs up or signs in with the same email address.

6. Using what you unlock

Your rights to use prompts, assets, templates and custom deliverables are set out in the License. In short: build as many personal and client projects as you like; do not redistribute or resell the library itself.

7. Acceptable use

You agree not to, and not to help anyone else to:

• Scrape, crawl, bulk-download or otherwise extract the library or any substantial part of it, by hand or with automation.
• Access the Service by any means other than the website and the MCP server we provide, or exceed rate and fair-use limits.
• Circumvent or attempt to circumvent paywalls, entitlement checks, quotas, signed URLs or other technical protections.
• Share accounts, resell access, or use one account to serve multiple people or organisations.
• Republish, resell, sublicense or distribute prompts, assets or templates as such, including inside “prompt packs”, datasets, marketplaces or competing libraries.
• Use the Service to train, fine-tune or evaluate machine-learning models without our written permission.
• Upload or submit content you do not have the right to share, or content that is unlawful, infringing, deceptive or harmful.
• Interfere with the Service, probe its security, or use it to send spam or malware.

We may investigate suspected violations, remove content, throttle or suspend accounts, and cancel purchases obtained in breach of these Terms.

8. Content you provide

You keep ownership of designs you submit to the creator program, messages you send to support and other content you provide. You grant us a worldwide, non-exclusive, royalty-free licence to host, display, adapt and distribute that content as needed to run and promote the Service, including publishing accepted creator designs in the library under the License.

You confirm that you have all rights needed to grant that licence and that your content does not infringe anyone else’s rights. The creator program has additional terms shown at submission time.

9. Third-party tools and services

The Service links to and works with third-party AI builders, code editors, video platforms and payment providers. Their terms and privacy practices apply to your use of them. We are not responsible for their availability, output or conduct.

Output generated by an AI tool from our prompts is produced by that tool. We do not guarantee that generated output is free of errors, original, or fit for a particular purpose; review it before you ship.

10. Intellectual property

The Service, the library, the Studio Prompts name and logo, and all software, text, media and compilations we publish are owned by us or our licensors and protected by copyright, trademark and other laws. Except for the rights expressly granted in the License, nothing in these Terms transfers any intellectual property to you.

If you believe content on the Service infringes your rights, email legal@studioprompts.com with enough detail for us to locate the material and assess the claim.

11. Affiliate and creator programs

Participation in the affiliate program and the creator program is subject to the program terms presented when you join, including commission rates, holding periods, reward amounts, payout methods and eligibility. We may change program terms prospectively with notice in your dashboard.

12. Availability and changes

We work to keep the Service available and fast, but we do not guarantee uninterrupted access. We may change, suspend or discontinue features, and we may update these Terms. Material changes are announced on the Service or by email at least 14 days before they take effect, unless the change is required by law or addresses a security issue. Continuing to use the Service after a change means you accept it.

13. Disclaimers

The Service is provided “as is” and “as available”. To the fullest extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. Nothing in these Terms limits rights that consumers have under mandatory law where they live.

14. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from your use of the Service. Our total liability for all claims in any 12-month period is limited to the amount you paid us in that period, or 100 units of the display currency if you paid nothing.

These limits do not apply to liability that cannot be limited by law, including for death or personal injury caused by negligence, fraud, or wilful misconduct.

15. Indemnity

If you are a business user, you will defend and indemnify us against claims, losses and expenses (including reasonable legal fees) arising from your breach of these Terms, your content, or your use of the Service in violation of law or third-party rights.

16. Termination

You may close your account at any time from your account settings or by emailing support@studioprompts.com. We may suspend or terminate accounts that breach these Terms, with notice where practical. On termination your licence to use the Service ends; rights you already acquired under the License to use unlocked content in projects you have built survive, and sections that by their nature should survive (payment obligations, disclaimers, liability limits, governing law) survive.

17. Governing law and disputes

These Terms are governed by the laws of [OPERATOR: governing law / jurisdiction], and the courts of [OPERATOR: governing law / jurisdiction] have exclusive jurisdiction, except that consumers may rely on the mandatory consumer-protection law and courts of their country of residence where applicable.

18. General

• These Terms, together with the documents they reference, are the entire agreement between you and us about the Service.
• If any provision is found unenforceable, the rest remains in effect.
• We may assign these Terms to a successor of the Service; you may not assign them without our consent.
• Our failure to enforce a provision is not a waiver.
• Notices to you are sent to the email on your account; notices to us go to legal@studioprompts.com.
